Welcome to Wealth Alchemy. These Terms of Service ("Terms") govern your access to and use of the website located at wealthalchemy.io (the "Site") and any products, services, or content offered by Enter Abundance LLC ("Company," "we," "us," or "our").

By accessing the Site, creating an account, or making a purchase, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site or purchase our products.

1. Eligibility

You must be at least 18 years of age to use this Site, create an account, or purchase products. By using the Site, you represent and warrant that:

You are solely responsible for maintaining the confidentiality of your password. We are not liable for any loss or damage arising from your failure to protect your account credentials.

3. Products and Orders

Product Descriptions:

We make every effort to display our products accurately, including descriptions, images, and pricing. However, we do not warrant that product descriptions, images, pricing, or other content on the Site is accurate, complete, reliable, current, or error-free.

Pricing:

All prices are displayed in U.S. dollars unless otherwise stated. Prices are subject to change without notice. We reserve the right to correct pricing errors and to cancel any orders placed at incorrect prices.

Order Acceptance:

Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including but not limited to:

• Product availability

• Errors in product or pricing information

• Suspected fraud or unauthorized transactions

• Violations of these Terms

Shipping and Delivery:

Shipping times and costs are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or other factors outside our control. Risk of loss and title for products pass to you upon delivery to the carrier.

4. Subscription Services

If you subscribe to receive products on a recurring basis:

• You authorize us to charge your payment method automatically at each renewal period

• Subscription terms, pricing, and frequency will be disclosed at the time of purchase

• You may cancel your subscription at any time by logging into your account or contacting us at support@wealthalchemy.io

• Cancellations must be submitted at least 7 days before your next renewal date to avoid being charged for the next shipment

• Cancellation does not entitle you to a refund of any amounts already charged

We reserve the right to modify subscription pricing or terms with reasonable advance notice to you.

Allergen Warning:

Our products contain mushroom extracts. If you have known allergies to mushrooms or fungi, do not use our products without first consulting your physician.

"Wealth Alchemy," the Wealth Alchemy logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Enter Abundance LLC or its affiliates. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

Limited License:

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use. This license does not include:

• Any resale or commercial use of the Site or its contents

• Any collection or use of product listings, descriptions, or prices

• Any derivative use of the Site or its contents

• Any downloading or copying of account information for the benefit of another party

• Any use of data mining, robots, or similar data gathering and extraction tools

We reserve the right to terminate this license at any time for any reason.

Violation of these Terms may result in termination of your account and legal action.

9. Marketing Communications

By creating an account or making a purchase, you may be given the option to receive marketing communications from us, including emails and/or SMS text messages about products, promotions, and news.

Email Communications:

If you opt in to receive marketing emails, you can unsubscribe at any time by clicking the "unsubscribe" link at the bottom of any marketing email or by contacting us at support@wealthalchemy.io.

SMS Communications:

If you opt in to receive SMS text messages, you consent to receive recurring automated marketing messages at the phone number provided. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for assistance.

Opting out of marketing communications does not affect transactional communications (such as order confirmations, shipping updates, or customer service responses).

Session Recording & Usage Consent

By participating in Bio-Harmony check-in sessions ("Sessions"), you acknowledge and agree to the following:

  1. Recording: All Sessions may be recorded in audio, video, or both formats.

  2. Usage Rights: You grant Wealth Alchemy and its affiliates a perpetual, worldwide, royalty-free, transferable license to use, reproduce, modify, edit, distribute, and display the recordings and any content derived from them for any purpose, including but not limited to:

    • Internal training and quality improvement

    • Product and service development

    • Marketing and promotional materials

    • Testimonials (written, audio, or video)

    • Social media content

    • Educational content

    • Case studies

    • Any other commercial or non-commercial purpose

  3. Data Usage: Information shared during Sessions may be used to improve our products, services, and customer experience. This may include anonymized or aggregated data analysis.

  4. No Compensation: You understand that no additional compensation will be provided for the use of your recordings, likeness, voice, or content beyond the services already included in your subscription.

  5. Waiver of Approval: You waive any right to inspect, approve, or be notified of any specific use of the recordings or derived content.

  6. Opt-Out: If you do not wish to be recorded, you may request an unrecorded session. However, unrecorded sessions do not qualify toward the monthly check-in requirement for refund eligibility.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE SITE, PRODUCTS, AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE

• THE RESULTS OBTAINED FROM USE OF THE SITE OR PRODUCTS WILL BE ACCURATE OR RELIABLE

• ANY ERRORS IN THE SITE WILL BE CORRECTED

• THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS

IN NO EVENT SHALL ENTER ABUNDANCE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• YOUR USE OF OR INABILITY TO USE THE SITE OR PRODUCTS

• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE

• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR ACCOUNT OR CONTENT

• ANY PRODUCTS PURCHASED FROM THE SITE

• ANY HEALTH-RELATED ISSUES ARISING FROM USE OF OUR PRODUCTS

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS, THE SITE, OR ANY PRODUCTS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless Enter Abundance LLC and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Site or products

• Your violation of these Terms

• Your violation of any third-party rights, including intellectual property, privacy, or publicity rights

• Any claim that your actions caused damage to a third party

• Your violation of any applicable laws or regulations

This indemnification obligation will survive the termination of these Terms and your use of the Site.

12. Dispute Resolution

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.

Informal Resolution:

Before initiating any formal dispute process, you agree to contact us at support@wealthalchemy.io to attempt to resolve any dispute informally. We will respond within 2 business days and work with you to find a fair resolution. Most concerns can be resolved quickly this way.

Small Claims Court:

You may pursue claims in small claims court in your county of residence (or in Laramie County, Wyoming, if you reside outside the United States), provided your claim qualifies under that court's rules. Neither party waives the right to bring qualifying claims in small claims court.

Binding Arbitration:

If we cannot resolve your dispute informally and you do not wish to pursue small claims court, you and Enter Abundance LLC agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or any products purchased (collectively, "Disputes") through binding individual arbitration rather than in court.

Arbitration Terms:

• Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at www.adr.org.

• The arbitration will take place in Cheyenne, Wyoming, unless you request a telephone or video hearing, or both parties agree to another location.

• Costs: If you initiate arbitration, you will pay only the AAA's consumer filing fee (currently $200). Enter Abundance LLC will pay all remaining arbitration costs, including arbitrator fees.

• The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement.

• The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver:

YOU AND ENTER ABUNDANCE LLC AGREE THAT ANY ARBITRATION OR COURT PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION. IF THIS CLASS ACTION WAIVER IS FOUND TO BE UNENFORCEABLE, THEN THE ENTIRETY OF THIS ARBITRATION AGREEMENT SHALL BE NULL AND VOID, AND THE DISPUTE WILL PROCEED IN COURT.

Opt-Out Right:

You may opt out of this arbitration agreement within 15 days of your first purchase or account creation (whichever is earlier) by sending written notice to support@wealthalchemy.io with the subject line "Arbitration Opt-Out" and including your name, email address, and a clear statement that you wish to opt out. If you opt out, you may pursue any claims in court, subject to applicable law.

Exceptions:

This arbitration agreement does not apply to:

• Claims for injunctive or equitable relief

• Claims related to intellectual property infringement

• Disputes that qualify for small claims court

13. Governing Law

These Terms, and any disputes arising from or relating to these Terms, your use of the Site, or products purchased from us, shall be governed by the laws of the State of Wyoming, without regard to its conflict of laws principles.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such finding shall not affect the validity of the remaining provisions, which shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

15. Entire Agreement

These Terms, together with our Return & Refund Policy and Privacy Policy, constitute the entire agreement between you and Enter Abundance LLC regarding your use of the Site and purchase of products, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.

16. Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Enter Abundance LLC.

17. Assignment

You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction.

18. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

For material changes, we will make reasonable efforts to notify you via email or a prominent notice on the Site.
